Section 01

About RateMarket

These Terms and Conditions ('Terms') govern your use of the RateMarket website located at ratemarket.com.au ('Site') and any services offered through it ('Services'). RateMarket is operated by Rate Market Global (ABN 71​ 142​ 642​ 396), registered in Queensland, Australia.

By accessing our Site or submitting an enquiry, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

Section 02

Nature of Our Services

RateMarket is a lead generation and referral platform. We do not provide financial advice, credit assistance, or act as a credit licensee. Our role is to:

• Collect loan enquiry information submitted by borrowers ('Leads')
• Match and sell those Leads to licensed mortgage brokers, finance brokers, or lenders ('Brokers')

We are not a party to any financial arrangement between you and any Broker. Any financial product or credit assistance you receive will be provided directly by the Broker under their own Australian Credit Licence (ACL).

Section 03

Eligibility

By submitting an enquiry through our Site, you represent and warrant that:

• You are at least 18 years of age
• You are an Australian resident or permanent resident
• The information you provide is accurate, complete, and not misleading
• You consent to your details being shared with Brokers for the purpose of receiving a callback or financial assessment

Section 04

Lead Submission and Consent

When you submit a loan enquiry form on our Site, you expressly consent to:

• RateMarket collecting, storing, and using your personal information as described in our Privacy Policy
• RateMarket sharing your personal information with one or more Brokers who may contact you by phone, email, or SMS
• Being contacted by Brokers regarding your loan enquiry and related financial products

You acknowledge that Brokers who contact you are independent third parties operating under their own licences and obligations. RateMarket is not responsible for the conduct, advice, or products of any Broker.

Broker Services — For Brokers

Brokers who purchase lead packages from RateMarket agree to:

• Hold a valid Australian Credit Licence (ACL) or be an authorised credit representative at all times during which they use our Services
• Use Leads solely for the purpose of contacting borrowers in connection with credit assistance
• Handle all personal information received through our platform in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles
• Not on-sell, transfer, or disclose Leads to any third party without the prior written consent of RateMarket
• Comply with the National Consumer Credit Protection Act 2009 (Cth), the NCCP Code, and all applicable ASIC guidance when providing credit assistance
• Not engage in misleading, deceptive, or high-pressure sales conduct when contacting Leads

Section 07

Lead Replacement Guarantee

RateMarket offers a lead replacement guarantee for Brokers on eligible lead packages, subject to the following conditions:

• A replacement request must be submitted within 48 hours of lead delivery
• A lead is eligible for replacement under the following three scenarios: (1) Duplicates — the lead is a duplicate of one already delivered to that Broker; (2) Fake Names — the lead contains an obviously fake or fraudulent name; or (3) Disconnected or Incorrect Mobile Numbers — the lead's mobile number is disconnected or invalid
• Replacements will be provided during the active campaign period for the order purchased and are not redeemable for cash or carried over to future orders
• Replacement requests will not be accepted where the Broker has already attempted contact and the borrower has declined to proceed

RateMarket reserves the right to assess replacement requests on a case-by-case basis and its decision is final.

Section 08

Payment Terms — For Brokers

Lead packages must be paid in full prior to delivery unless otherwise agreed in writing. All prices are listed in Australian Dollars (AUD) and include GST unless stated otherwise. Payment is accepted via bank transfer or such other methods as published on our Site. Refunds are not provided except where required by Australian Consumer Law.

Section 09

Intellectual Property

All content on our Site, including text, graphics, logos, and software, is owned by or licensed to RateMarket and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

Section 10

Limitation of Liability

To the maximum extent permitted by law:

• RateMarket provides the Site and Services 'as is' and makes no warranties regarding accuracy, completeness, or fitness for a particular purpose
• RateMarket is not liable for any loss or damage arising from your reliance on information provided on our Site or from the conduct of any Broker
• Our total liability to you for any claim arising under these Terms will not exceed the amount paid by you to RateMarket in the 3 months preceding the claim

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law that cannot be excluded by agreement.

Section 11

Indemnity

You agree to indemnify and hold harmless RateMarket, its directors, employees, and agents from any claim, loss, damage, or expense (including legal fees) arising from your breach of these Terms, your use of the Site, or any information you provide that is false, misleading, or inaccurate.

Section 12

Termination

RateMarket may suspend or terminate your access to the Site or Services at any time, with or without notice, if you breach these Terms or if we reasonably believe your conduct may cause harm to RateMarket or third parties.

Section 13

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference and is available at ratemarket.com.au/privacy-policy.

Section 14

Governing Law

These Terms are governed by the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising out of or relating to these Terms or your use of our Services.

Section 15

Changes to These Terms

We may update these Terms at any time. The current version will be published on our Site with an updated effective date. Your continued use of our Site after any changes constitutes your acceptance of the revised Terms.
